Terms of Service
Please read these terms carefully before using Omi POS. By using the platform, you agree to be bound by the terms below.

1. Agreement to TermsThese Terms of Service ("Terms") govern your access to and use of Omi POS's website, applications and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
"You" refers to the individual or entity registering for or using the Service. "We" or "us" refers to Omi POS.
2. Description of ServiceOmi POS provides an all-in-one operations platform for nail salons, letting you:
- Book appointments and manage per-technician work schedules
- Check in walk-in clients with automatic queueing
- Charge for services and products, with commissions calculated automatically per technician
- Manage customer information (CRM) and service history
- Send automated appointment reminders via SMS/Zalo
- View real-time revenue and performance reports
- Manage multiple locations under one account (Enterprise plan)
3. Account RegistrationTo use the Service, you must create an account. You agree to:
- Provide accurate, current and complete information
- Keep your password and login credentials secure
- Be responsible for all activity under your account
- Notify us immediately of any unauthorized access
4. Acceptable UseYou agree NOT to use the Service to:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Send spam or harass customers
- Transmit malware or viruses
- Attempt to gain unauthorized access to systems or data
- Interfere with or disrupt the Service
- Impersonate another person or organization
5. Your Responsibilities
5.1 Customer Data and ConsentYou are the data controller for any personal data of your customers that you process through the Service. You are responsible for:
- Obtaining necessary consent from your customers, including consent to receive SMS/Zalo reminders
- Providing appropriate privacy notices to your customers
- Complying with applicable personal data protection laws in Vietnam
5.2 Automated Features & Call CenterSome Omi POS features (such as automated call handling) use automation technology. You are responsible for configuring and monitoring these features appropriately for your business, and disclosing their use to customers where required by law.
6. Subscription and Payment
6.1 FeesAccess to certain features requires a paid plan. Fees are listed on our Pricing page and may include monthly/yearly subscription fees and add-on feature fees.
6.2 BillingYou authorize us to charge your provided payment method (card, bank transfer, e-wallet). Subscription fees are billed in advance for each period. Except as expressly stated, fees paid are non-refundable.
6.3 Price ChangesWe may change our fees with 30 days' notice. Continued use of the Service after the effective date constitutes acceptance of the new pricing.
6.4 Free TrialWe offer a free trial with no credit card required. After the trial period, you'll need to add a payment method to continue on a paid plan.
7. Intellectual PropertyThe Service, including all software, content, designs, trademarks and related materials, is owned by Omi POS or our licensors. You receive a limited, non-exclusive, non-transferable license to use the Service under these Terms. You retain ownership of content you upload to the Service. You grant us a license to use, store and process that content solely to provide the Service.
8. Service AvailabilityWe strive for high availability but do not guarantee the Service will be uninterrupted. The Service may be temporarily unavailable due to scheduled maintenance, emergency maintenance, or circumstances beyond our reasonable control.
9. Third-Party IntegrationsThe Service may integrate with third parties such as payment gateways and SMS/Zalo providers. Each integration is subject to the respective provider's own terms. We are not responsible for third-party service availability or changes.
10. Termination
10.1 By YouYou may cancel your subscription at any time in your account settings. Cancellation takes effect at the end of your current billing period.
10.2 By UsWe may suspend or terminate your access if you violate these Terms, fail to pay fees, or if we discontinue the Service. We will provide notice when reasonably possible.
10.3 Effect of TerminationUpon termination, you may export your data within 30 days. After that, we may delete your data according to our retention policy.
11. Disclaimer of WarrantiesTHE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.
12. Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, OMI POS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE OR LOST DATA.Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
13. IndemnificationYou agree to indemnify and hold Omi POS harmless from any claims, damages or expenses arising from your use of the Service, your violation of these Terms, your customer data and how you process it, or your failure to comply with applicable law.
14. Dispute Resolution & Governing LawThese Terms are governed by the laws of Vietnam. Any disputes will first be resolved through good-faith negotiation; if no agreement is reached, disputes will be submitted to the competent courts of Vietnam.
15. General Provisions
- These Terms constitute the entire agreement between you and Omi POS regarding the Service.
- We may modify these Terms at any time. Material changes will be communicated with 30 days' notice.
- If any provision is found unenforceable, the remaining provisions continue in effect.
- Failure to enforce any right does not waive that right.
- You may not assign these Terms. We may assign them to an affiliate or successor.
